By downloading, installing, or using Trade Buddy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.
2. Description of Service
Trade Buddy is a trading journal and analytics application designed to help traders track, analyze, and improve their trading performance. The App provides:
- Trade logging with detailed entry/exit information
- Screenshots and voice note attachments
- Performance analytics and charts (PnL, win rate, equity curve)
- Multi-account management (Forex, Crypto, Stocks, Futures)
- Trading playbook for saved setups
- Import functionality from various platforms (MT4, MT5, brokers)
- Gamification features (quests, achievements, XP)
- Economic calendar
3. Important Financial Disclaimer
IMPORTANT NOTICE:
Trade Buddy is a trading journal and analytics tool. It is NOT:
- A financial advisory service
- A provider of investment recommendations
- A source of trading signals or tips
- A licensed broker or financial institution
RISK WARNING: Trading in financial markets involves substantial risk of loss and is not suitable for all investors. You may lose more than your initial investment. Past performance does not guarantee future results.
By using this App, you acknowledge that:
- All trading decisions are your own responsibility
- Historical data and statistics are for informational purposes only
- You understand and accept the risks involved in trading
- You should consult a qualified financial advisor for investment advice
4. Requirements
To use the App, you must:
- Be at least 18 years of age
- Have a compatible iOS or Android device
- Agree to these Terms and our Privacy Policy
5. Subscriptions and Payments
5.1 Free and Premium Features
The App offers both free features and premium features available through subscription ("Trade Buddy Pro"). Free users have access to basic journaling with certain limitations.
5.2 Subscription Options
Premium subscriptions are available in the following plans:
- Monthly: Billed every month
- Yearly: Billed annually
- Lifetime: One-time purchase, permanent access
5.3 Billing
All payments are processed through Apple's App Store or Google Play Store. By purchasing a subscription:
- Payment will be charged to your account at confirmation of purchase
- Subscription automatically renews unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store or Google Play account settings
5.4 Refunds
All purchases are final. Refund requests must be made through Apple or Google. We do not have the ability to issue refunds directly. Visit reportaproblem.apple.com (Apple) or Google Play support to request a refund.
6. User Content and Data
- Ownership: You retain ownership of all trading data, notes, screenshots, and content you create using the App.
- Local Storage: All your data is stored locally on your device. We do not have access to your trading data.
- Responsibility: You are responsible for backing up your data and ensuring its accuracy.
7. User Conduct
You agree NOT to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices
- Transfer your account or subscription to another person
- Circumvent any access or usage restrictions
- Use the App to store or transmit malicious code
8. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, software, and code, are owned byWizlab and are protected by international copyright, trademark, and other intellectual property laws.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Trading losses or missed opportunities
- Service interruption or data loss
- Errors in calculations or analytics
- Any financial decisions made based on data in the App
Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- Calculations and analytics will be 100% accurate
- The App is free of viruses or harmful components
11. Indemnification
You agree to indemnify, defend, and hold harmless Wizlab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:
- Your use of the App
- Your trading activities
- Your violation of these Terms
- Your violation of any third-party rights
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the App will immediately cease
- We are not obligated to refund any fees paid
- Your locally stored data will remain on your device until you delete the App
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Thailand.
