1. Acceptance of Terms

By downloading, installing, or using Nature ID ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Nature ID is an AI-powered nature identification application for iOS. The App provides:

• Camera-based identification of spiders, snakes, insects, butterflies, mushrooms, rocks, crystals, fossils, fish, plants, wood, and grass
• Danger level assessments (safe, cautious, dangerous, venomous, poisonous)
• Detailed species information (habitat, diet, size, fun facts)
• Nature journal for saving identifications
• Map view for tracking discovery locations
• Shareable result cards

5. Eligibility

To use the App, you must:

• Have a compatible iOS device (iOS 17.0 or later)
• Agree to these Terms and our Privacy Policy

The App is rated 4+ and may be used by individuals of all ages. Subscription purchases require parental consent for minors.

6. Free and Pro Features

6.1 Free Features

Free users have access to:

• 3 identifications per day
• Basic results (common name and danger level)
• Last 10 identifications in journal
• Share cards with watermark

6.2 Pro Features (Nature ID Pro)

A subscription unlocks:

• 100 identifications per day
• Full detailed results (habitat, diet, size, lifecycle, fun facts, similar species)
• Full safety information
• Unlimited nature journal
• Map view
• Clean share cards (no watermark)
• Ad-free experience

7. Subscriptions and Payments

7.1 Subscription Plans

Nature ID Pro is available as an auto-renewable subscription:

• Weekly: $4.99 USD per week
• Annual: $29.99 USD per year

7.2 Free Trial

New subscribers may be eligible for a 7-day free trial. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

7.3 Billing

All payments are processed through Apple's App Store. By subscribing:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

7.4 Refunds

All purchases are final. Refund requests must be made through Apple. Visit reportaproblem.apple.com to request a refund.

8. Image Handling

When you use the identification feature:

• Your image is sent over HTTPS to our Cloudflare Worker proxy
• The proxy forwards the image to Google Gemini for AI identification
• Images are processed in memory and are NOT stored on any server
• Identification results are returned to your device and stored locally in your journal

9. User Content and Data

• Ownership: You retain ownership of all photos and journal entries you create using the App.
• Local Storage: Journal entries, identifications, and location data are stored locally on your device.
• Responsibility: You are responsible for backing up your device data.

10. User Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer your subscription to another person
• Circumvent any access or usage restrictions (including rate limits)
• Use the App to store or transmit malicious code
• Abuse the API by sending automated or bulk identification requests

11. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, software, and code, are owned by Wizlab and are protected by international copyright, trademark, and other intellectual property laws.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Incorrect identification of species
• Failure to correctly identify venomous, poisonous, or dangerous specimens
• Injuries, illness, or death resulting from reliance on identification results
• Loss of journal or collection data
• Service interruption or API unavailability

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Identifications will be accurate or reliable
• Danger level assessments will be correct
• The App will be uninterrupted or error-free
• The AI model will correctly identify all species
• Results will be suitable for safety-critical decisions

14. Indemnification

You agree to indemnify, defend, and hold harmless Wizlab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your reliance on identification results for safety decisions
• Your violation of any third-party rights

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• Active subscriptions can be cancelled via App Store settings
• Your locally stored data will remain on your device until you delete the App

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Thailand.
